Your successful pathway to Australian Permanent Residency
The partner visa is one of the most popular visas in use under the Australian family migration stream. Yet its successful outcome is heavily reliant on the accuracy of details. We all one day have fallen in love a though that we had found the one, The One that knocks us off our feet the one that makes us complete.
Unfortunately, love is just not enough when it comes to applying for Australian Permanent Residency under the spousal migration stream. The stream may comprise up to 3 different visas in order to be granted permanent residency. The journey is expected to be a lengthy one. Depending on the applicant’s situation diverse avenues may be required for a successful outcome. Not one application is the same, however, most of them are similar. What is included in an application will be the capstone to success or failure.
One of the most significant items in the application for a spousal visa is the demonstration that the relationship is “Genuine” and “Continuing” to the “Exclusion of all others”. Now, this may seem to one as a basic thing, however, this is what could make or break a successful application.
I have highlighted the 3 keywords Genuine, Continuing, Exclusion of all others because all the latter elements must be present. One cannot have;
- A genuine relationship that is not continuing; or
- a genuine and continuing relationship that is NOT to the exclusion of all others; or
- a continuing relationship that is to the exclusion of all others but that is NOT genuine.
The above are basic requirements behind a partner visa. Many other elements are required to demonstrate the presence of a genuine and continuing relationship to the exclusion of all others as well as the lodgement of a decision-ready application.
